The supreme court only really decides matters if constitutional law. Furthermore, for a case to get to the supreme court you need a bunch of the lower courts to have conflicting rulings. The supreme court only hears a tiny amount of cases per year so I don’t see why this would reach the top.
This would almost certainly be decided by a lower court. A ruling then could be appealed but unless there is something major (unlikely) chances are a decision by the court would stand.
